Before submitting your payment we require you to read the following information very carefully and then tick the appropriate box to confirm your understanding and acceptance of the Retreat Terms and Conditions.

Private Room Option or Twin Share Room Option. Please notify Laura upon booking confirmation.
Experience:
The Retreat experience will be a personally enlightening but also potentially challenging one. You acknowledge that you will be required to undertake personal self-enquiry through art and journaling and contribute openly in group spaces with other retreat participants as a part of the retreat experience.
Liability:
In the rare circumstances where this type of work has unintended negative consequences you waive the right to hold Laura Jane Day responsible for any damage and/or liability that may arise as a result of retreat work. Facilitation of the meditation, art activities and/or coaching is not therapeutic work and should not be considered as such. For issues that may arise for individuals in processing this work, participants agree to seek professional assistance/counselling where required.
Privacy:
All privacy and confidentiality requirements will be observed at all times. Neither the attendee nor the retreat leaders shall disclose to third parties or use for any purpose any information provided by the other unless:
1. Required by law;
2. The information is already generally known to the public, or
3. The other consents to the disclosure; Presentation material remains the property of Laura Jane Day.
Emergency:
In a medical emergency an ambulance will be called on your behalf if one is deemed necessary and will be at your own cost. You will also be required to nominate an emergency contact prior to arrival. If you have any medical conditions, this must be communicated with Laura ahead of going on the retreat.
Retreat Fee Inclusions – Private Room: The Retreat fee is: $3,497 AUD (Early Bird – Pay In Full Price) or $3,797 AUD (Full Fee – Pay In Full) or $3,997 (Payment Plan) Includes: experiences, art materials, accommodation, transfers to and from accommodation on first and final day, Breakfast, Lunch, Afternoon Tea for 6 x days and a final night celebration dinner is included in the Retreat Fee.
Retreat Fee Inclusions – Twin Room: The Retreat fee is: $3,297 AUD (Early Bird – Pay In Full Price) or $3,597 AUD (Full Fee – Pay In Full) or $3,497 (Payment Plan) Includes: experiences, art materials, accommodation, transfers to and from accommodation on first and final day, Breakfast, Lunch, Afternoon Tea for 6 x days and a final night celebration dinner is included in the Retreat Fee.
Retreat Fee Exclusions: Dinner and alcoholic drinks are not included in the Retreat fee. Also costs related to any additional outings and transport expenses not listed on the Retreat schedule. For example the cost of a taxi to and from old town.
The Retreat fee does not include: your airfares, passport or visa fees, taxes, travel and health insurance, telephone or wifi expenses, excess baggage charges, any services not listed in the final itinerary, or any items of a personal nature.
You must have your own travel insurance as a requirement for attending this Retreat & obtain your own travel documents and Tourist Visa’s to travel to Vietnam.
Payment Terms:
The participant shall pay the full fee as set out in these terms or enter into a payment plan. It is your responsibility to READ AND UNDERSTAND OUR CANCELLATION POLICY PRIOR TO BOOKING your retreat ticket.
Cancellation By Guest:
If a request for cancellation is received one hundred and twenty (120) or more days prior to the start date of the retreat, a full refund minus your $497 AUD non-refundable deposit will be returned.
If a cancellation request is received between one hundred and nineteen (119) days and ninety one (91) days prior to the start of the retreat, 50% of the total retreat cost will be refunded. If the guest entered into a payment plan the 50% will be calculated from the full retreat ticket cost and not the balance you have paid to date.
Any cancellations from ninety (90) days prior to the start date of the retreat will be non-refundable. NO EXEPTIONS can be made for any unexpected event, including weather, injury / illness, or personal emergencies.
No Refund will be given if a retreat guest is a no-show, becomes un-well or injured whilst on retreat and cannot fully participate in the activities, leaves early or arrives late.
It is highly recommend that you purchase your own travel insurance ASAP to cover trip cancellation or any other unforeseen circumstances.

Cancellation By Host:
We reserve the right to cancel the retreat in the event we do not reach minimum numbers. In which case the balance of your retreat ticket will be refunded in full. Notification of retreat cancellation for this reason will occur at least 1 month (30 days) prior to the retreat start date.
It is highly recommend that you purchase your own travel insurance ASAP to cover trip cancellation.
In the instance that the retreat is cancelled, we cannot be held responsible for any personal expenses incurred, such as airline tickets due to changes in itineraries or retreat cancellations. It is your responsibility to read and understand our cancellation policies prior to making any purchase decisions in regards to travel expenses related to your trip.
Independent Suppliers:
Laura Jane Day is not liable for any acts, omissions, failures, or defaults on part of the persons or entities who, at the request of Laura Jane Day, provide transport, accommodation or similar services or facilities to you during the Retreat, or on your way to or from the Retreat.
Laura Jane Day does not own or manage any transportation vehicles, hotels, or restaurants or any other supplier.
Travel Insurance:
Travel insurance is Required for all Retreat Attendees due to the nature of our operations and the costs associated in the event of an accident.
While incidents are rare, Laura Jane Day wants to ensure that all of our guests are fully protected.
You are required to provide proof of your travel insurance upon payment of the final balance.
Consideration must be given to cancellation policy: in the event of injury, evacuation, delayed flights or illness Laura Jane Day does not refund, therefore travel insurance is your safeguard.
When selecting a Travel Insurance product, please ensure that it provides cover against personal accidents or injury, medical expenses, emergency repatriation and personal liability, cancellation for any reason including bereavement, delayed flights, lost luggage and personal effects.
Waiver Form:
Laura Jane Day requires that each guest sign the waiver form on arrival at the Retreat.
This form indemnifies Laura Jane Day, its servants and agents or any of them from and against all costs, claims, actions, demands and liability whatsoever and howsoever arising from or in any way connected with the Retreat (including any transportation to or from the accommodation or in which a group excursion is to take place) including such costs, claims, actions, demands or statutory duty or otherwise on the part of Laura Jane Day, or any of its servants or agents, and including any liability in respect of or related to your death, personal injury or loss of or damage to any property owned or possessed by you.
By agreeing to this document you also give us various acknowledgements:
Health and Fitness Requirements – Guests must be in good health and be moderately fit in order to attend a Retreat.
Changes to Itinerary – Laura Jane Day may amend or vary the Itinerary or other services nominated on our website or other publications where required and at the absolute discretion of Laura Jane Day.
Medical Forms and Doctors Certificates – If you have a pre-existing medical condition/s you are required
to disclose this on your booking form and may be required to supply a doctor’s certificate or complete a confidential medical questionnaire.
Intellectual Property Rights – Without Laura Jane Day’s prior written consent, you must not share, copy, distribute, or otherwise disseminate any materials received at or in relation to the Retreat electronically or otherwise without prior written consent.
Laura Jane Day and / or Guest Facilitators will educate you in the facilitator’s signature artistic style. This is for educational purposes only and you are prohibited from creating and selling work that is substantially derivative of that style.
All intellectual property, including the copyrighted Retreat materials, shall remain Laura Jane Day’s sole property and no license to sell or distribute any materials is granted or implied.
If you breach this clause, Laura Jane Day may seek injunctive relief at the your cost.
Media – The use of photographs, videos or audio recordings from the Retreat that reflect or depict you, your work or your participation may be used by Laura Jane Day in all or any marketing or promotional efforts.
Consent Release Waiver and Disclaimer:
You agree that:
This retreat is organized and managed by LJD Ventures PTY LTD (“the Company”), hosted by Laura Jane Day (“the Host”). For the purposes of this document, both the Company and the Host will collectively be referred to as “LJD”
– You are responsible for reading all information provided by LJD before and during the Retreat, including any and all terms, agreements, schedules, policies, procedures and notices related to the Retreat, including travel and Program Activities.
– The use of photographs, videos or audio recordings from the Ignite Creative Wellness Retreat that reflect or depict you, your work or your participation may be used by LJD in all or any marketing or promotional efforts.
– You acknowledge that your content including: video, audio, and photographic content may be shared and used publicly to promote the Retreat experience and inspire others.
– You will follow any reasonable instructions or directions given or provided by LJD, or its representatives or agents.
– All Guest Allergies & Preferences will be recorded and attended to; however LJD cannot and does not guarantee that food provided will be safe for those with food allergies or sensitivities. LJD does not have responsibility or control over food preparation or contamination and is not liable for any act, default or omission of any supplier related to the food or products provided on the Retreat.
– You agree to seek medical advice prior to and during the Retreat regarding any concerns about your health. In the event of an emergency, I authorize LJD to seek medical treatment on my behalf. I understand that I am responsible for any medical expenses incurred.
Exclusion of Liability:
You acknowledge that:
– You are attending the Retreat at your own risk and you take full responsibility for your own physical and mental well-being and for your possessions during the Retreat.
– You are voluntarily participating in any Program Activities you choose to attend at the Retreat.
– You may decline to participate in any of the Retreat activities at any time. Even those deemed compulsory on the schedule.
– LJD does not accept responsibility for any loss or damage to your luggage or personal property, nor for any loss, damage, delay, illness, fatality or other injury suffered. You hereby, to the full extent permitted by law, waive all of your legal rights of action against and fully release LJD from all liability arising from or connected with your death or personal injury present or future, arising out of or in relation to the participation by you in the retreat including without limitation, liability for a negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty on the part of the LJD, its officers, directors, employees, agents or consultants.
– You attend the Retreat at your own risk.
Acknowledgement:
This waiver shall bind you and your personal representatives. By agreeing to this form, I confirm that I have read and understood its content. I grant my permission as outlined above. I enter this agreement freely and voluntarily, and intend my acceptance of these terms to be a complete and unconditional release of all liability to the greatest extent permitted by law.
Limitation of Liability:
Laura Jane Day does not exclude or limit the application of any provision of any statute where to do so would contravene that statute or cause any part of this contract to be void.
Laura Jane Day excludes all:
– statutory liability;
– tortious liability (including negligence);
– conditions and warranties implied by custom, the general law or statute; and
Liability for:
– all special, indirect, incidental, consequential or punitive damage;
– economic loss, loss of profits, loss of revenue, loss of bargain, loss of goodwill, loss of anticipated savings, or loss of use of products or equipment, arising out of or relating to these terms and conditions, the retreat, or any failure to supply or delay in supplying the retreat, whether or not Laura Jane Day was aware or should have been aware of the possibility of such loss or damage.
Laura Jane Day’s liability to you for any breach of any express or implied provision of these terms and conditions is limited, at Laura Jane Day’s option, to:
– refunding the price of the goods or services in respect of which the breach occurred; or
– providing, replacing or repairing those goods; or
– providing those services again.
Indemnity:
You must indemnify and hold harmless Laura Jane Day and each of its officers, employees and contractors against any losses, costs, claims, damages, expenses, liabilities, proceedings or demands which any of them may directly or indirectly incur or suffer as a consequence of any breach by you of your obligations under these terms and conditions.
Jurisdiction:
The law of Victoria, Australia shall apply to this Contract.
Notice:
All correspondence or notices that are required and regarding the Retreat shall be made to us at laura@laurajaneday.com and to you at the e-mail address provided by the guest upon booking.
Entire Agreement, Assignment, Survivability and Waiver:
– This Agreement contains our entire agreement.
– This Agreement may be amended in writing, signed by both parties.
Dispute Resolution:
A Party must not commence legal proceedings relating to these Terms and Conditions unless that Party has complied with this clause.
The Parties must act in good faith and use their best endeavours to resolve, by mutual agreement, any disputes that may arise between them regarding this Agreement.
Any dispute which is not resolved under the clause directly above must be dealt with as follows: the Party claiming that a dispute exists must notify the other Party of that dispute in writing (Notification); within 10 days of receipt of Notification, the dispute must be referred to the signatories of the Agreement, or their nominees, for resolution; if the dispute is not resolved within 28 days of Notification, the dispute must be
referred to an Australian mediator agreed by the Parties, or the Australian Commercial Dispute Centre Limited (ACDC) for mediation; and if the Dispute is not resolved within 60 days of referral to a mutually agreed mediator or the ACDC, either Party may initiate court proceedings.
Counterparts:
The Agreement may be executed in any number of counterparts. Each counterpart is an original, but the counterparts together are one and the same agreement.
The Agreement is binding on the Parties on the exchange of counterparts. A copy of a counterpart sent by electronic transmission:
– must be treated as an original;
– is sufficient evidence of the execution of the original; and
– may be produced in place of the original.
Variation:
Any variation or amendment to this Agreement must be made in writing and signed by the Parties.
Agreement:
By ticking the box, and paying the Retreat Deposit Fee, I confirm that I have read and understood the Retreat Terms and its content.
